The US CLOUD Act obliges American companies to hand over data they hold — anywhere in the world. Not only data kept in America. Data in Frankfurt, Dublin or Paris too, if an American company is the one holding it.

“But it is hosted in Europe.” It does not matter where the building is. The CLOUD Act reaches whoever runs it.

“But they promised not to train on my data.” That is a promise not to learn from it. It is not a promise not to hand it over.

“But there is a European contract and standard clauses.” Your contract binds your supplier. It does not bind an American court.

“But it is encrypted.” It cannot summarise a document it cannot read. Somewhere in the middle, it is readable.

And you would not be told. An order can arrive with a gag attached, so the company that handed your conversation over is not allowed to say that it did.

HOW GDPRCHAT IS BUILT INSTEAD

Your chats reach exactly two companies, both European, both running the work on their own machines. Scaleway runs the AI in Paris. Hetzner stores everything in Germany.

No American or Chinese company receives your chats — not even the labs that built the AI models, because Scaleway runs those models on its own hardware and their makers receive nothing.

So there is nothing for a CLOUD Act order to reach. No American company holds your chats, and Scaleway states that its AI services are not subject to the CLOUD Act.
